What is Bankruptcy?

Bankruptcy provides you protection against creditors and allows for a fresh financial start. Bankruptcy can help relieve your financial stress by eliminating credit card debts, medical bills, and other unsecured debts.

Types of bankruptcy proceedings:

  • Chapter 7 Bankruptcy - This type of bankruptcy is sometimes referred to as straight bankruptcy or liquidation bankruptcy. In a Chapter 7 bankruptcy, you turn over your non-exempt property over to a trustee who then converts them into cash to pay off your unsecured debts, such as credit card debts, medical bills, and other unsecured loans. The rest of your unsecured debts are completely discharged and you get a fresh start.
  • Chapter 13 Bankruptcy - Sometimes called the wage-earner plan. File a Chapter 13 bankruptcy if you want to keep your non-exempt property and work on paying your debts over a period of time. You qualify for Chapter 13 bankruptcy if you have predictable and sufficient amount of income to pay reasonable living expenses and some amount of money left over to pay off your debts.

  • Repossessed Mobile Home, filed for bankruptcy - Creditor lost $58,183 for willfully violating the automatic stay of a Chapter 7 bankrupcty. The original mobile price: $21,500. Debtor filed for bankruptcy on Aug. 27 and showed the bankruptcy petition to the creditor's agent on Aug. 28, but the agent still took the home with the debtor still in it. The court said the creditor was "callous, if not brutal" and had the intention to humiliate the debtor.
